Digital Asset Estate Planning

Digital Assets & Cryptocurrency in Your Will

Cryptocurrency, NFTs, online investment accounts, and digital businesses are increasingly significant parts of people's estates — but most wills make no provision for them. Without the right planning, these assets can be lost forever when you die.

We advise on how to include digital assets in your will and estate plan — ensuring your executors can identify, access, and transfer them without compromising your security during your lifetime. Chester-based, acting across Cheshire, North Wales and England and Wales.

The risk: digital assets can be lost forever

Unlike a bank account, cryptocurrency held in a self-custody wallet cannot be recovered without the private key or seed phrase. If your executor does not know these exist — or cannot find the access credentials — the assets are permanently lost. The same applies to online investment accounts, digital businesses, and other digital assets. A properly drafted will and a secure access document are essential.

Types of digital assets we advise on

Cryptocurrency

Bitcoin, Ethereum, and other cryptocurrencies held in exchange accounts or self-custody wallets. We advise on how to include these in your will and how to ensure your executor can access them.

NFTs and digital collectibles

Non-fungible tokens and other digital collectibles can have significant value. We advise on how to identify, value, and transfer these assets as part of your estate.

Online investment accounts

Stocks, shares, and investment portfolios held through online platforms. We advise on how to include these in your will and ensure your executor can access and transfer them.

Digital businesses and domain names

Online businesses, websites, domain names, and intellectual property can be valuable assets. We advise on how to include them in your will and succession plan.

How we help

01

Digital asset audit

We help you identify and document all your digital assets — including cryptocurrency, online accounts, and digital businesses — so nothing is overlooked in your estate plan.

02

Will drafting for digital assets

We draft will provisions that specifically address your digital assets — including how they should be identified, accessed, and distributed — without including sensitive access credentials in the will itself.

03

Secure access documentation

We advise on how to create and store a secure document containing access credentials for your digital assets — separate from your will, but accessible to your executor when needed.

04

IHT and CGT advice

Cryptocurrency and other digital assets are subject to inheritance tax and capital gains tax. We advise on the tax treatment of your digital assets and any planning opportunities available.
