What is unfair dismissal?

Unfair dismissal occurs when your employer terminates your employment without a fair reason or without following a fair procedure. You must have been employed for at least 2 years to bring a claim.

What is constructive dismissal?

Constructive dismissal is when you resign because your employer's conduct made it impossible for you to continue working there. This is treated as a dismissal in law.

How long do I have to make a tribunal claim?

Usually 3 months from the date of dismissal or the act complained of. You must also go through ACAS Early Conciliation first.

What is a settlement agreement?

A legally binding agreement between you and your employer to settle any employment claims. You must receive independent legal advice before signing.

Can I claim for discrimination at work?

Yes, if you have been treated less favourably because of a protected characteristic (age, disability, gender, race, religion, sexual orientation, etc.).
