Service in the UK Armed Forces can result in injuries and health conditions that are not always immediately apparent — and that may not be diagnosed until years after leaving the Forces. Who Can Make a Military Claim?

Our military legal services are available to:

Current serving members of the UK Armed Forces (Regular and Reserve)
Veterans — including those discharged many years ago
Reservists — Army Reserve, Royal Naval Reserve and RAF Reserve
Those whose injury or illness developed or worsened after discharge
Personnel from all branches — Army, Royal Navy, Royal Air Force
Dependants of service personnel who died as a result of service

You do not need to be currently serving to make a military claim. Many military injuries — including hearing loss, tinnitus and cold injuries — are diagnosed or worsen after discharge. Time limits apply, so early advice is important.

Claim Options Explained

There are three main routes for military compensation. We will advise which is most appropriate for your circumstances.

Civil Claim Against the MOD

Where the Ministry of Defence failed in its duty of care — for example, inadequate hearing protection, unsafe training practices or failure to diagnose and treat an injury. Requires proof of negligence but can result in higher compensation.

Suitable for: serving personnel and veterans

Armed Forces Compensation Scheme (AFCS)

A no-fault scheme for injuries and illnesses caused by service on or after 6 April 2005. You do not need to prove negligence. Administered by Veterans UK with tariff-based awards.

War Pensions Scheme

For injuries and illnesses caused by service before 6 April 2005. Provides a War Disablement Pension based on the assessed level of disablement. No strict time limit for claims.

What types of military injury claims can I make?

Military injury claims cover a wide range of conditions including hearing loss and tinnitus (NIHL), PTSD and psychiatric injury, non-freezing cold injury (NFCI), training and exercise injuries, and military medical negligence. Both civil claims against the MOD and AFCS claims are available routes.

Do I need a military solicitor to make a claim?

While you are not legally required to use a solicitor, specialist military claims solicitors understand the unique complexities of MOD claims, AFCS procedures and the particular pressures of service life. Expert legal advice significantly improves your prospects of a successful outcome.

Can I make a military personal injury claim after leaving the Forces?

Yes. Veterans regularly bring successful military personal injury claims for conditions that developed or worsened after discharge. You do not need to be currently serving. Time limits apply, so early advice is important.

What is the difference between the AFCS and a civil claim against the MOD?

The AFCS is a no-fault scheme — you do not need to prove negligence. It provides tariff-based awards for injuries caused by service on or after 6 April 2005. A civil claim against the MOD requires proof of negligence but can result in higher compensation. In some cases, both routes may be available.

How long does a military injury claim take?

Timescales vary depending on the type of claim and whether it is pursued via the AFCS or as a civil claim against the MOD. We will give you a realistic assessment of timescales at the outset.

Will making a military claim affect my career?
