What is a Lasting Power of Attorney?

A Lasting Power of Attorney is a legal document that allows you (the donor) to appoint one or more trusted people (your attorneys) to make decisions for you if you lose mental capacity.

There are two types of LPA in England and Wales:

Property & Financial Affairs LPA

Allows your attorney to manage bank accounts and savings, pay bills and manage income, property ownership, sales or lettings, and investments and pensions. Can be used with your consent while you still have capacity, or later if capacity is lost.

Health & Welfare LPA

Covers decisions about medical treatment and care, care home arrangements, daily living and support, and life-sustaining treatment. This LPA can only be used if you lose mental capacity.

You can make one or both types, and you can set specific instructions or preferences to guide your attorneys.
