What happens if I lose capacity before making an LPA?
If you have already lost mental capacity, it is too late to make an LPA. In this situation, a family member or other person would need to apply to the Court of Protection to become a deputy. This process is significantly more expensive and time-consuming than making an LPA in advance. We strongly recommend acting early.

A Lasting Power of Attorney (LPA) is a legal document that allows you to appoint one or more people (your "attorneys") to make decisions on your behalf if you lose mental capacity. There are two types: a Property & Financial Affairs LPA, which covers decisions about your bank accounts, property, investments and financial matters; and a Health & Welfare LPA, which covers decisions about your medical treatment, care arrangements and daily living.

Without an LPA, if you lose capacity, your family would need to apply to the Court of Protection for a deputyship order — a process that is significantly more expensive, time-consuming and stressful than making an LPA in advance. The Court of Protection process typically costs £3,000–£5,000 or more in legal fees, compared to £82–£164 in government registration fees for an LPA.
