Frequently Asked Questions

Do you act for clients in North Wales?

Yes. We act for clients across North Wales — including Wrexham, Flintshire, Deeside, Denbighshire, Conwy and Anglesey. Our Chester office is conveniently located close to the North Wales border, and many of our clients travel from North Wales for appointments. We can also advise by telephone or video call.

Is the law on LPAs the same in Wales as in England?

Yes. Lasting Powers of Attorney are governed by the Mental Capacity Act 2005, which applies across England and Wales. There is no difference in the law or process for clients in North Wales compared to those in England. We regularly act for clients from across North Wales and understand any cross-border considerations that may arise.

Do I need to come to your Chester office?

Not necessarily. We can conduct initial consultations by telephone or video call, and many clients prefer this. However, for the signing of LPA documents, we may need to meet in person — either at our Chester office or, in some circumstances, at your home. Our Chester office is easily accessible from Wrexham, Flintshire, Deeside and across North Wales.

How much does an LPA cost for a North Wales client?

The cost of an LPA is the same regardless of where you live. There is a government registration fee of £82 per LPA (£164 for both types). Our solicitor fees are fixed and confirmed in writing before any work begins. Contact us on 01244 757 352 for a no-obligation quote.

Can you advise on LPAs for clients with property in both England and Wales?

Yes. We regularly advise clients who have property or financial interests in both England and Wales. The LPA framework applies across both jurisdictions, and we will advise you if your circumstances require any specialist cross-border consideration.

What happens if I lose capacity before making an LPA?

If you have already lost mental capacity, it is too late to make an LPA. In this situation, a family member or other person would need to apply to the Court of Protection to become a deputy. This process is significantly more expensive and time-consuming than making an LPA in advance. We strongly recommend acting early.

Lasting Powers of Attorney for North Wales Clients

A Lasting Power of Attorney (LPA) is a legal document that allows you to appoint one or more people (your "attorneys") to make decisions on your behalf if you lose mental capacity. There are two types: a Property & Financial Affairs LPA, which covers decisions about your bank accounts, property, investments and financial matters; and a Health & Welfare LPA, which covers decisions about your medical treatment, care arrangements and daily living.

Making an LPA while you have mental capacity is one of the most important steps you can take to protect yourself and your family. Without an LPA, if you lose capacity, your family would need to apply to the Court of Protection for a deputyship order — a process that is significantly more expensive, time-consuming and stressful than making an LPA in advance. The Court of Protection process typically costs £3,000–£5,000 or more in legal fees, compared to £82–£164 in government registration fees for an LPA.

For clients in North Wales — including Wrexham, Flintshire, Deeside, Denbighshire, Conwy and Anglesey — the law on LPAs is the same as in England. The Mental Capacity Act 2005 applies across England and Wales, and there is no difference in the process for North Wales clients. Our Chester office is conveniently located close to the North Wales border, and we regularly act for clients from across the region.

At PDA Law, we offer a fixed-fee LPA service with costs confirmed in writing before any work begins. We can conduct initial consultations by telephone or video call, and many clients prefer to deal with us remotely. For the signing of LPA documents, we can meet at our Chester office or arrange a home visit in appropriate circumstances. Call us on 01244 757 352 for a free initial discussion.

Related: Wills, Trusts & Estates

An LPA is an essential part of estate planning — and works best alongside a professionally drafted will. Our wills, trusts and estates team can help you plan ahead so your affairs are in order for every eventuality.

Related: Probate

When a donor dies, the LPA ceases and the executor named in the will takes over. Understanding how LPA and probate interact helps families plan ahead and avoid costly Court of Protection applications.
