There are two types of Lasting Power of Attorney in England and Wales: the Property and Financial Affairs LPA and the Health and Welfare LPA. They serve very different purposes and can be used at different times.
Property and Financial Affairs LPA
Covers managing bank accounts, paying bills, collecting income, making investments, and buying or selling property. Unlike a Health and Welfare LPA, it can be used while you still have mental capacity.
Health and Welfare LPA
Covers where you live, your day-to-day care, medical treatment decisions, and — if you choose — decisions about life-sustaining treatment. Can only be used once you have lost mental capacity.
Without a Health and Welfare LPA, medical professionals are not legally required to consult your family about your treatment. Making both types of LPA ensures your chosen attorneys have authority over all aspects of your life.
