What is a sale of part?

A sale of part involves selling a portion of land that you own — typically a garden, paddock, or plot — while retaining the rest. It is more complex than a standard property sale because it requires the creation of a new title, careful boundary definition, and consideration of rights and restrictions that will affect both the land sold and the land retained.

Boundary definition

The boundaries of the land being sold must be precisely defined. This typically requires a plan prepared by a surveyor. We will advise you on the requirements before you commit.

New title creation

A sale of part creates a new title at Land Registry. This involves more legal work than a standard sale and requires careful drafting of the transfer deed.

Rights and restrictions

The transfer deed must address rights of way, drainage, services, and any restrictions that will apply to the land sold and the land retained. Getting this wrong can cause problems for years.

Mortgage lender consent

If there is a mortgage on the property, your lender's consent is required before you can sell part of the land. We liaise with your lender as part of the process.
