Frequently Asked Questions

What should I do if I am involved in a fatal road traffic accident?

You must stop, remain at the scene, and provide your details. You should not make any admissions to police without legal advice. Contact us immediately — early legal advice is critical in fatal accident cases.

What is the difference between causing death by dangerous and careless driving?

Causing death by dangerous driving requires that the driving fell far below the standard of a careful and competent driver. Causing death by careless driving requires only that the driving fell below that standard. The distinction is crucial — the maximum sentence for dangerous driving is 14 years, compared to 5 years for careless driving.

Can I get bail if charged with causing death by dangerous driving?

Bail is possible but not guaranteed for serious road traffic offences. The court will consider the seriousness of the charge, your personal circumstances, and any risk of reoffending or absconding. We will make the strongest possible bail application on your behalf.

What is a hit and run offence?

Section 170 of the Road Traffic Act 1988 requires a driver involved in an accident causing injury, damage, or death to stop, remain at the scene, and provide their details. Failing to stop and failing to report are separate offences, each carrying up to 6 months imprisonment and 5–10 penalty points.
