Common Calculation Mistakes
Using gross income instead of net
The calculator uses gross annual income. Courts assess net income (after tax and National Insurance). Your actual maintenance figure may differ.
Ignoring capital assets
If one party has significant capital assets (property, savings, investments), these may reduce or eliminate a maintenance claim — even where there is a large income gap.
Forgetting pension income
Pension income counts as income for maintenance purposes. If either party is close to retirement, pension projections should be included in the assessment.
Not considering earning capacity
Courts assess realistic earning capacity — not just current income. If the recipient is underemployed or has deliberately reduced their income, the court may impute a higher income.
