Related Steps — What Else You May Need
If you are experiencing domestic abuse — whether physical, psychological, emotional, financial or coercive control — you have legal options to protect yourself and your children. The courts can act quickly, and in urgent cases, an injunction can be obtained on the same day.
At PDA Law, our family law solicitors in Chester handle domestic abuse cases with the sensitivity and urgency they require. We understand that taking the first step can be the hardest — and we are here to help you understand your options, at your own pace.
Types of Injunction Available
Non-Molestation Order
Prohibits the abuser from using or threatening violence, intimidating, harassing or pestering you — and from contacting you directly or indirectly. Breaching a non-molestation order is a criminal offence punishable by up to five years in prison.
Occupation Order
Regulates who can live in the family home. Can require the abuser to leave the property, prevent them from returning, or restrict them to certain parts of the property. Can be granted even if the abuser owns or rents the property.

Occupation Order with Children — Cheshire
Abuser removed from homeSecured an occupation order requiring an abuser to leave the family home in Cheshire, allowing the primary carer and children to remain in a safe, stable environment.
Coercive Control Case — North Wales
Comprehensive protection securedRepresented a client experiencing financial and emotional coercive control. Obtained injunctive relief and coordinated with child arrangements proceedings to protect both the client and their children.
Urgent Applications — Same-Day Orders
In urgent cases, the court can grant an injunction on the same day — without the other person being notified first. This is called a "without notice" (ex parte) application.
Without notice applications are appropriate where there is an immediate risk of harm and it would not be safe to wait for a hearing at which both parties are present.
We can advise on whether an urgent application is appropriate for your circumstances and act quickly to protect you.
